About Jonathan Zittrain
Jonathan Zittrain is the George Bemis Professor of International Law at Harvard Law School and the Harvard Kennedy School of Government, Professor of Computer Science at the Harvard School of Engineering and Applied Sciences, Vice Dean for Library and Information Resources at the Harvard Law School Library, and co-founder of the Berkman Klein Center for Internet & Society. His research interests include battles for control of digital property and content, cryptography, electronic privacy, the roles of intermediaries within Internet architecture, human computing, and the useful and unobtrusive deployment of technology in education.
He performed the first large-scale tests of Internet filtering in China and Saudi Arabia, and as part of the OpenNet Initiative co-edited a series of studies of Internet filtering by national governments: Access Denied: The Practice and Policy of Global Internet Filtering; Access Controlled: The Shaping of Power, Rights, and Rule in Cyberspace; and Access Contested: Security, Identity, and Resistance in Asian Cyberspace.
He is a member of the Board of Directors of the Electronic Frontier Foundation and the Board of Advisors for Scientific American. He has served as a Trustee of the Internet Society and as a Forum Fellow of the World Economic Forum, which named him a Young Global Leader. He was a Distinguished Scholar-in-Residence at the Federal Communications Commission, and previously chaired the FCC’s Open Internet Advisory Committee. His book The Future of the Internet — And How to Stop Itpredicted the end of general purpose client computing and the corresponding rise of new gatekeepers. What does it mean to demonstrate compliance under the GDPR? What kind of documentation is expected from an organisation to show that they meet their legal requirements? Nymity is midway through a 3-year project on demonstrating compliance to regulators to help provide more clarity on this issue, as published in a recent paper Demonstrating Compliance to Regulators. | Accountability is one of the key pillars of the GDPR. Organisations are to ensure their privacy program meets the legal requirements and need to be able to demonstrate this upon request. Those organisations already working with Binding Corporate Rules (now codified in Article 47 GDPR), are already familiar with the need to be accountable, if they want to be able to transfer data between all branches and establishments of their group. If you meet the requirements for BCRs, you are likely on track to meet your GDPR requirements. Vice versa, if you meet your GDPR requirements, a lot of the preparations for BCRs will likely be done already.
This webinar will address the differences between GDPR obligations and BCR obligations to understand the necessary investment in privacy management required to apply for BCRs. Also, this webinar will speak to the advantages of BCRs as a data transfer mechanism, helping you to make the assessment if BCRs are useful for your organisation. Apart from just showing internally that you are compliant with the law, many companies are also looking for more public ways to confirm that they are meeting their data protection obligations. The GDPR offers various options to do so: adherence to a (sectoral) code of conduct, the development of Binding Corporate Rules or certification.
Article 42 and 43 GDPR allow for the development of certification mechanisms, seals and trust marks to demonstrate compliance with the provisions of the Regulation. In addition, the GDPR offers the possibility to non-EU data controllers, to certify their privacy program to assert they have implemented appropriate safeguards for data protection. This specific certification would allow for data transfers, even when no adequacy decision is in place. Nymity currently has a research project ongoing that looks into the various elements of GDPR certification.
During this webinar, we will look at both past and current certification mechanisms across the world and discuss lessons learned, based on our research project. Next, we will look ahead at what certification mechanisms under the GDPR could look like and why companies should consider to certify their privacy programs or their privacy technology. This will include the question if, and to what extent, Binding Corporate Rules could be regarded as a form of certification. Finally, we will discuss with representatives of the Article 29 Working Party what their guidance on the use of certifications under the GDPR could entail.
